Agreed, legal recovery is not the same as default. You can't claim until legal recovery has commenced. But I don't think that of itself is enough grounds for a claim. See here for why: p2pindependentforum.com/post/218979/thread. I'm not on MT but where loans are secured on property of the borrower, and that property is still there, I don't think you can claim.
