15 Duty of Confidentiality
15.1 Lending Members are permitted to access the information on the Website solely for their personal use or in the course of their business for the purpose of assessing whether or not to participate in a Loan and for administering Loans that have been advanced. The content of the Website is not permitted to be used for any other purpose.
15.2 Each Lending Member accepts that it owes a duty of confidentiality to the Assetz Capital Companies with regard to:

20.3 You acknowledge and agree that the contents of the Loan Auction Particulars, the identity of potential or actual Borrowers, any other information provided by or on behalf of a potential or actual Borrower and the contents of the Loan Documents are private and confidential and you may not disclose any such information to anyone (save as may otherwise be required to be disclosed by any applicable law or regulation).
20.4 You further acknowledge and agree that the Loan Auction Particulars are only made available to Lender Members for the purposes of deciding whether to make an offer of a Loan. They are not intended for any other purpose and their contents may not be disclosed or copied to any third party or used for any other purpose without the Borrower’s prior written authority.

13. Protecting FundingSecure Information

19.2 You acknowledge and agree that the identity of Borrowers on the platform is confidential and you may not (unless required by law) disclose the identity of any Borrower to anyone except your Independent Financial Advisor or legal advisors.

19.4 Nothing in this clause prevents the discussion of Borrowers and Loans on discussion forums, provided that the provisions of this clause are complied with. If you breach the provisions of this clause 19, you may become liable to us under clause 26.2.

26.2 You will be liable to us for any foreseeable loss or damage suffered by us as a result of:
a) any breach by you of these Terms, any Loan Contract, or the Website Terms of Use;
b) your negligence or wilful default;
c) any fraudulent use by you of the MoneyThing Platform; and
d) any and all misuse of your username, password, the Website, the MoneyThing Platform or MoneyThing account.
26.3 You will not be liable to us for any loss or damage which is not foreseeable.
