I expect that what FS said was true. But a 'legal opinion' is only an opinion. The wife probably has a legal opinion that says the opposite. The only way to resolve this is likely to be a very expensive court case. The winners won't be the FS investors or the wife -- they'll be the lawyers! Of course. The two lawyers probably know within 5 minutes what is legally correct, but that's only £40 apiece, and another £40 each to write and tell both clients what they want to read. Go to court. Now, argue discuss "things" on the phone for a couple of half hours, that's another £480 each. Attend court and argue. Let's say £2000 each for that. Job done. Ta! £2560 each for a £40 job. See ya round the pub after, Tarquin? Not that any of that story could possibly resemble reality. I know nothing. Edit: PLUS VAT. THE GOVERNMENT WANTS ITS £512. IT AMAZES ME THAT THEY HAVEN'T FOUND A WAY OF CHARGING VAT ON THE VAT YET. It is done for fuel, VAT due on the duty ! Least we're not on that "escalator" any more, blimmin Nora. Anyway a £25 hit for me on this one I think.

Having said that, it will be very interesting over the next year to see how the current plethora of speculative land loans bear out phil : Have you continued your FS investment? If so, have you updated the loan performance statistics you provided in this thread about a year ago? I expect people here would be interested in any more up-to-date analysis you've done, and knowing how another year's worth of data has affected your view of FS. Well the borrower has paid interest to date, is working on the site and £600k should be recoverable in a fire sale scenario based off the previous valuation... I'll put the £25 in that arrived too late for yesterday's jewellery

Not in this one, but it seems to me that each time a call for cash is made, a RICS valuation should be made of the current value of the site ?
It'd only take an hour of a surveyor's time or so and should be done at eacdh stage of lending. Obviously someone would have to pay for it but its very obviously spending a penny to save a pound !

THis is the residual loan I'm happiest with in Funding Secure at the moment, would gladly trade my powerboat or K********** property parts for more of this one ! (I'd think about it with the maritime memorabilia...)
With a bit of luck and a following wind it might even complete before christmas..

I guess the question is, if you could afford it, would you buy the security yourself for your country pile or Mayfair penthouse...
Personally I wouldn't with this one, and art is worth as much as someone will pay for it...
