Mousey
Fantastic summary - as I said I found it very difficult to follow So far good news - I guess Green never planned of legal action against him - sadly it is money that bought him to trial but hopefully this sends out a message to other muppets planning a similar scam...

Well that's nearly 4 hours of my life wasted. I should have just waited for Mousey 's summary. The morning session left me thinking that he would get to keep his pension; the afternoon session left me feeling more hopeful that the law would allow for justice to be done, but not enough to bet on it.

And in either case someone has to pay for three dudes lifting the chairs in and out for the three judges.

I understand the Court of Appeal will hand down their Judgment at 10am on Tuesday 25th October.

Thanks for the update Mousey, as always.
I'm probably pessimistic about anything FS these days but I won't get over excited!

FUNDINGSECURE ART FRAUDSTER FAILS AT COURT OF APPEAL
Three senior judges have unanimously dismissed a fraudsters appeal that 1,400 members of the public, hoodwinked as part of a £2.3m art-loan investment scam, should not be able to recover their money from his family pension scheme. Even though only 4 investors will see the majority of the cash recovered I am delighted Mr G will have his pension fund emptied.

I really hope this is the case - I am no expert here but my research indicates to me that he may be able to retain part of it so hopefully I am wrong - any legal beagle care to comment - this is a complicated piece of law
Whatever it looks likes his plan to scam FS nearly worked but didn't due to thanks whatsoever to FS/administrators/FCA etc but the 4 wealthy lenders who took legal action against him
To these 4 1 say thank you - if I get 25% back that will be 25% more than I expected!

I see two morals from this saga.
Wealth doesn't translate as you'd expect to due diligence and being cautious about fraud and con men. There would have been a lot of £50 investments in those loans as well.
If you are serial fraudster (not stating he is) eventually you will cross the wrong person or people. In this case he had a pension to pay his debts, some suffer in other ways. If jail was more likely or mandatory, financial crime might not be a growing business. The premis that financial crime doesn't physically hurt people like other crimes is moronic.

white collar crime.i hope that these platforms/directors are all brought to account for their actions.fraud by misrepresentation is just one of the offences that these platforms/directors should answer.

Been thinking about this scammer - living in Spain and having a private "therapist" can't be cheap - I presume he has no other income - I wonder if he has borrowed against his UK pension pot - I do hope so!

I get the impression Daddy pays . He's sold a good few mediocre impressionist paintings recently.

Been thinking about this scammer - living in Spain and having a private "therapist" can't be cheap - I presume he has no other income - I wonder if he has borrowed against his UK pension pot - I do hope so! Seems unlikely*. As travolta suggests, it's possibly more a case of Daddy sending him the occasional wedge to keep him over there where he's (marginally) less of an embarrassment. (Also, someone has to be fronting his legal challenges and that'll be waaaay more expensive, in the short term at least.) But, that to one side, I don't understand why you'd hope he had " borrowed against his UK pension pot" - wouldn't that be a bad thing? If there was a loan secured again the pension pot, wouldn't that at the very least just delay things for those fighting to get something out of it and, worse, possibly dilute the (diminishing) sum available to those four claimants and, by extension, to all FS Lenders in this series of loans, including yourself? * - I think pre-existing loans with any kind of claim against the pot would have surfaced during the court cases. Getting anything since his bankruptcy in 2019 also seems unlikely, imo.

I understand the asset held by the pension fund is the unencumbered freehold of the family art gallery.
