I understand there will be a hearing on Thursday in relation to this matter.
I loosely understand the trustees of the borrowers families pension fund, of which the entire debt + interest is now secured against, is applying to set aside the judgment which found the borrower had acted in a deceitful and fraudulent manner. And their chances of success ?

My loose understanding is now a bit firmer - I now understand the application on Thursday is in fact whether to continue or discharge the charging order that has been placed on the pension fund. The application to set aside the judgment is awaiting directions.
As for a chance of success - no idea.

Well ive tried to ignore the scoreline comment..thats right in my solar plexus and im winded. As for what this is costing, unless ive got the wrong end of the stick.. again, the litigants acting on lenders behalf have that to reconcile with out of their 30%

I hope so but I am not convinced - sometimes I am optistimic over this one and other times very depressed - torture - that said I really feel for the investors with large sums in this one,
I guess the final verdict on this one will be a very significant legal precedence

Update 30/07/21
As you are aware, FundingSecureās litigation was assigned to a third party who are responsible for any further action to recover funds. We have now received an update from the purchasers of the litigation however only very limited details can be disclosed at the present time.

I think we all knew the outcome before litigation was assigned to a third party. It was pretty much obvious that it is a 100% loss as soon as these loans defaulted, FBI was after the borrower and the rest of it. It wouldn't make any difference, whether administrators disclose details or not. This loan is the most sizeable in my remaining FS loan book (Italian Books is the second). Can't blame anyone but myself for the "books", but for the "art" - I would've never invested as much as I did if I knew that they were to the same borrower.

Anyone know if this prick is going to jail? I don't know. But great minds think alike, apparently, since just this afternoon I was ruminating on a list of "top P2P fraudsters who deserve to fester behind bars this Christmas". An unfinished piece of work which wound me up no end...
