RSM milking this for all its worth.how many hours of fees will be racked up on this distribution of lenders funds on just these 2 loans? i expect any future returns to also take time to allow for hours of fees to be justified.

£890,104 legal costs? This is our money defending Lendy against the borrower for incompetently lending money to a highly dubious person. Where is the justice in this?

It seems in the legal system you can forced to defend against claims that have no merit and be yourself out of pocket for vast sums of money; on that basis anyone could threaten you with legal action at no risk to themselves.

Sorry that's not quite correct.
Claims that are 'without merit' can be struck out at relatively little expense.
The situation here is very complicated and it was determined by a High Court Judge that "the [borrower] appear to have a good arguable case." As I've said before on here, that doesn't mean the court would grant the remedy the borrower is seeking, but to describe their application as without merit is wrong.

I presume this will all go to court? It could go to court but do we have any chance of winning - really not sure! Does anyone know how it will affect us if we are turned into model 1 borrowers, if LAG win the court case?

Does anyone know how it will affect us if we are turned into model 1 borrowers, if LAG win the court case? An order for costs has been made, but the borrower is a set of off-shore companies. The PG was provided by someone who was, at the time. a student and is therefore likely to be 'judgment proof'.

I must admit I am not in favour of going to court. It would be good money after bad. However, why on earth did Lendy lend money to an offshore company with a student guarantor giving us little chance of recovering any money if things went wrong? Surely Lendy is liable for something?! I partly blame myself for not checking all of this up but there is a point where you just have to trust experts (so-called).

It's the enforcement that might prove tricky.
That's a good question - why indeed. Lendy may well be liable, but are in administration.
