Just for the record, I fully support Lendy on this matter. The borrower is in absolute breach and deserves to be brought to pay.

I have reason to believe someone connected to the borrower's legal team is studying the posts made on this forum.
The more we give the impression of worrying about the issue, the harder they will push it. Their aim is to get us to agree to their settlement offer by intimidation / bullying tactics. The only answer (in the short term) is to "turn the other cheek".
This remains for now, just a threat, until there is evidence that a lender has actually been joined to the case.
If they are smart they have presumably informed their employers to make sure they get paid up front, I doubt they would get paid afterwards.

Is it worth keeping a daily record of the stress this is causing, time off work etc? Anyone preparing to countersue if this nonsense does indeed turn out to be true.

I almost feel it’ll be worth dragging this out as long as possible so that when these borrowers (chancers) lose the case, their costs will send them bankrupt. Karma.

I think it’s very easy to lose perspective here. Without giving anything away to prying eyes, given the size of the claim made and dividing that by the number of investors, that number isn’t particularly large and that’s worst case. Given the almost zero chance of a successful claim there’s nothing to worry about in my opinion. We just need to go through the long legal process. If this claim was ever successful it would set a precedent whereby everyone with this common type of loan would be in court sueing their lender.
Just my opinion of course.

I lend a few hundred pounds in good faith (I did not know the name of the borrower) to this project, they take my money and refuse to pay it back, and they appear to be saying I have committed fraud? Their lawyers will have my name, and directly accuse me of fraud? Have I got this right?

A rhetorical question no doubt, asked on a point of sheer amazement at gall of this lady. That why i say be prepared to countersue for the stress and defamation caused by this claim if indeed it is true, and someone is THAT STUPID.

Actually, I don’t feel too good this evening, andygod1, it could well be due to these potential allegations hanging over me, because I’ve been quite well for many years. I think I’ll keep a diary of the symptoms.....for my doctor....it may come in handy.

I get all the emails - so not me, but there must be hundreds who have no clue about this - if they go on to not ack service - can they get stuck with a huge default judgement?
Someone asked about FCA back up the thread, I did ask, 'no comment' other than acknowledging they authorize Lendy.
