No. Maybe something has changed since the last successful case of this type although the Housing claims are paying out tranches. This one is quite old now so maybe it is something to do with HMRC or the always helpful FCA.

Another positive return on 3898 This will be the 27th HDR loan tranche repayment. That brings the percentage of capital returned from that loan to 33%, and the total profit per £1k invested to £63.98. It takes the annualised return that has been earned on the returned capital from that loan to an XIRR of 20.84%. The overall XIRR for my HDR case investments where at least one repayment has been received has increased to 21.60%. Assuming an equal amount was invested in each of the 7 HDR cases that have received at least 1 tranche repayment so far, the XIRR is 21.36%. For each £1k equal investment (£7k across the 7 loans), £2,790 of capital and £613.19 profit (£3,403.19 total) would have been paid so far.

Shareholder Dispute (Case ID: 3784) has settled, report expected next week. This case was also funded by #3565, #3950 and #4554. Professional negligence claim (Case IDs: #2510, #3536 and #4102) has also settled and also is expected to report next week. I'm in 6 of those loans, so I'm on tenterhooks waiting to know what the settlement figures are. Anything near the full accrued returns would jump AxiaFunder from no. 5 to no. 1 in my most profitable platforms so far list. I'm not expecting to get the full accrued profits since a settlement was agreed, but even a typical 30% profit haircut would jump AF to no. 1 for me. Exciting times. The settlements have been announced for the professional negligence claim. #2150 resulted in a 45% profit (a total 6% XIRR across the 3 cases in this portfolio loan, where 1 of the 3 cases resulted in a loss, so a good overall result in the circumstances). #3536 resulted in a 31.4% profit (a total 20.1% XIRR across the 3 cases in this portfolio loan, where all 3 cases settled positively). #4102 resulted in a 30.1% profit (57% XIRR). Payments will be made by Friday.

Still no news about #3784, #3565, #3950 and #4554 which is odd so I'm looking forward to the explanation.
I wasn't in 2150, 3536 and 4102, were those cases the same defendant and claimant? The spread in XIRR needs to be analyzed and considered for future investments.

This case had a strong legal merit, but the value of damages was looking to be much lower than expected. Allowing it to proceed to court could have resulted in a much lower return, due to the extra costs that would be incurred and the extra time cost of the tied-up capital. And there is always a chance that we could have lost. A return of capital and a modest profit is a sensible compromise. The average profit across the three tranches was 35.5%, so not too shabby. At the end of the day, it's up to the Claimant to decide whether to accept any negotiated settlement or whether to risk taking the case to court. We have no choice but to trust AxiaFunder to negotiate on our behalf with the Claimant and legal team such that we all come out with a reasonable settlement. I'm happy for them to do that as they have a good record of doing just that so far. In this case, we all took a substantial haircut. These commercial cases, when considered individually, are very high risk. We absolutely should expect a proportion of them to lose. I would certainly invest in new cases as diversification is extremely important to mitigate the risk of large losses on a small number of cases. Having said that, I've only had 1 loss so far, and that was part of a portfolio of 3 cases which still generated an overall profit, as the other 2 cases won and insurance paid out for the bulk of the capital in the lost case. I've had other cases where I've received a profit of over 100%.

Yes, those 3 loans all related to the same case, though 2150 and 3536 were also packaged with 2 other cases each. The spread of the XIRRs is greatly influenced by the other packaged cases and the length of time and differently agreed economics of the 3 tranches of this, now settled, case. 4102 resulted in a higher XIRR because it was a top-up funding that was raised in March this year and ranked ahead of the other 2.
