Nothing to do with P2P, or finance, but was wondering if somebody can assist me.
About 4 months ago my employer moved from paper pay slips to electronic ones, and I was asked to supply my personal email address for them to send the link each month to the electronic slip (which I did). My company is signed up to a benefits programme (be caring / hapi benefits) and these people have been sending emails to my private address, urging me to sign up to their programme. I have no interest in this offer and have asked them in writing to remove me from their mailing list. They say they cannot do so unless instructed by my employer.
I contacted my employer and asked them to instruct 'be caring' to remove me from their list, but they appear unable to do so. Since my request I have received a letter from my employer extolling the virtues of 'be caring', and a further email from BC reminding me that I haven't signed up yet. To say that I am fed up with the situation is an understatement. Can anyone out there advise:
- Did my employer breach the data protection act by asking for my personal email address for pay slip purposes, and then passing it onto 'be caring' without my knowledge and approval
- If I wanted to threaten 'be caring' with legal action, what laws have they broken by refusing to remove me from their list.
I'm retiring in a couple of months so don't care to much if I ruffle a few feathers

Highlight the emails as junk and get on with your life, (same goes for mobile or landline calls) you should not let these leaches have any influence whatsoever on your normal day to day life.

First thing to ascertain, did they? Given the ubiquity of email, and corporate email systems (eg even a single owner restaurant I know well uses WhatsApp as an internal comms tool) this is pretty skinny - do you work in a coracle you built yourself? 2. .... and then passing it on to "be caring" without your knowledge and / or approval?Are you sure about that? Signed nothing? Ticked no check boxes? It's terribly easy to do, in a rush, bored, distracted, simply got better things to do..... As I understand it there are either laws in place to... limit... these kind of "restrictions of rights" contracts, or there is intent to implement such laws, but... where are you now? But what if it was written in to your contract? I don't know. But if I was your employers lawyers I would know well. 3. Which is not to say that they haven't, and is not to say that they won't be found to be in breach of this or that regulation, but if it comes down to:- Your employer - "We use Be Caring to manage our payroll". agent69 - "But I never gave my company permission to give my details to Be Caring...". Court - "But you did, because you are an employee, see your signature here...". agent69 - "But I want them to stop sending me emails"..... Court - "......."

If you've got the energy then go for it, but have you really....? I was contemplating something similar yesterday for something I very definitely didn't sign up with, who after I finally recently hit unsubscribe on their emails phoned me yesterday and addressed me by my real name to ask me if they could send me investment stuff....livid was not the word. Problem is once you start reading the ICO website there are so many get out clauses for legal reasons to be allowed to keep various data (and I seem to recall one of the examples they gave was around employers/payroll) I'm really not sure it'd be worth the hassle (for me) to pursue....especially as as we saw from the Huddle/COL mailing list issue it seems all they'll do is say "oops sorry dunno where we got your details from, we'll delete you". To me it seems that all GDPR does is make it harder for "good" companies and makes no difference to the shadier ones. Outright scammers aside I think the only thing you can really do is make a point of never using the spammers ever, and perhaps point out to them that you'll be recommending others avoid them too.

Does your company have a benefit of life insurance whilst you are an employee? If so is that provided by BC? So your personal details going to BC might be legitimate. Whether they should be using those details for up-selling is another thing.
You could write to one of the newspaper columnists that enjoy this kind of thing to see what comes out.
