If they can't even update us within the timescale that they set themselves .... I have no doubt the FCA have worked out who the 'dancing duck' is by now so I will say that I have submitted an official complaint that points this out. I have asked for all Col complainants to be given an update and a detailed explanation as to why the deadline was missed.

I wonder if anyone else other than duck or I have followed up on the lack of any update on this case? I kind of thought that my email would prompt either a holding statement or a reason for the delay, or remind them to publish yet another postponement, but still nothing. These guys don't half like to rub salt in to the wound, do they? I rather get the impression that it might have come as a surprise to them that six months has come and gone.

I wonder if anyone else other than duck or I have followed up on the lack of any update on this case? ..... I know of one definite who has sent in a complaint. I know I joked ' should have sent in a complaint' but after I had posted that I thought 'Complaints Commissioner' and since the previous Commissioner had said he would keep an eye on timescales this complaint might come in useful. That said the complaint will now be 'in the system' so might not see daylight for some time. That said I have the statement (twice) on complaints So the review date will not come as a surprise to the Complaints Team.

Well perhaps they are reading this forum as I've just received email notification that they have again deferred their decision to investigate this complaint.
IMO, the decision to defer the complaint again (which has now been defered several times) must surely be balanced by the fact that the investigation may take longer and become more difficult to conclude due to the passage of time. Witnesses may be more difficult to locate, memories and recollections of events will become more faded, and related documents may have been lost or destroyed. Their own investigation of course - has not even started yet, and that may be a time consuming process in its own right.
I think that they should commence their investigations forthewith in to the issues raised. If necessary, the provisional findings could be withheld and made subject to a final review following the conclusion of the FCA investigation. This would mean that their decision could be delivered faster than would otherwise be the case if they wait until the conclusion of the FCA process. It would also reduce the increasing risks that I mentioned above which are caused by the passage of time.

The FCA knew back in the first couple of months of 2018 how the Col problem had occurred. How the register was changed etc. This was an easy task. The FCA will be relying on BDO for all the detail (this will be paid for by investors via recoveries). Witnesses have been contacted over the past couple of years, possibly longer now, some statements were made a long time ago. Document have been supplied either directly to the FCA or via BDO. What is not clear from any wording or phrasing at the Treasury Committee is will the complaints be dealt with before any Court Proceedings or after. The previous Complaints Commissioner has already said he thought delaying until after Court Proceedings would be unreasonable since that could take several more years. I'm afraid (as I have posted before) another deferment was inevitable, we will have to wait potentially until the start of September for anything meaningful.

I have also received today an FCA email deferring my complaint. I guess the wording will be the same as others’ emails.

Just been looking at my deferment notice again.
I note the date at the top (live field) was inserted by T.... S..... on 7th JUNE 2021 with the date given as 06 June 2021 My name was inserted by the same person on 7th JUNE
So these deferrals were sent today with a date of one month ago on the top making it look like the deadline was met!
....... and of course it means the notice was written a month ago.
Anybody else received similar?

Same 6 June received yesterday Mine and another one I saw matched that, and comparing back to the earlier versions is clearly done differently. Probably safe to assume that everybody received identical (apart from name) copies. Maybe duck could comment if he feels there is some mileage in doing anything with the information? Or if it is just useful background.
