It is understood that the sentencing hearing has been adjourned until Friday 14th July 2023. This is due to previous cases overrunning. The defendants continue to remain on bail. What a shame after just receiving the latest report from BDO, winds me up at the amount of losses

Currie bro's due to be sentencedAndrew and Peter Currie are expected to be sentenced tomorrow at Southwark Crown Court after being found guilty by a jury of fraud offences a few weeks ago. It can now be revealed that at a preliminary hearing at Westminster Magistrates Court in January 2022 Ms MacDonald, the barrister representing the Financial Conduct Authority, had told District Judge Clark that they sought a " sentence in excess of 7 years". Developments in the case in the intervening time may have altered this. For counts one and two, both offences under section one of the Fraud Act, the judge is likely to have regard to the sentencing guidelines to determine the outcome for each defendant. Live issues for the first two counts are likely to include the culpability of each defendant, the level of harm caused, and how any personal mitigation may affect or reduce the sentence. After some very generous donations, and with only a small amount outstanding, we have a journalist booked to cover the sentencing, expected to commence at 2pm. We will report the headline sentence as it comes in followed by a full report later on. There's no guarantees in the legal system so it may well be that the hearing is adjourned - watch this space. Listed for a 10am start tomorrow.

The hearing on the 11th January 2023 has been significantly extended too: "Mr Biggs explained that there was a potential problem with the application – that Peter Currie’s legal team wasn’t actually requesting a specific document so he was “not sure what order the defence is seeking”."

And the hearing on January 26th 2023, in which I had made an application for court documents. All parties resisted my application for a copy of the case summary with Peter Currie's barrister saying it was “ the first example in this case which I’m in absolute agreement [with the FCA]” I've linked to the application and the response in the blog post, for those who are interested in a 'behind the scene' view of some of what I do.

Those documents make an interesting read. From my experience as a McKenzie Friend in criminal courts I know how much 'the system' tries to obstruct anybody who is not in the club.
