@mousey Was there any mention of contempt of court proceedings given that M**** blatantly lied in his most recent witness statement? I have no idea about "Law", but that is a good question I would think. Surely if a signed statement on a very serious matter is subsequently proven to be blatant and false then the whole case gets thrown out? How do you believe anything else presented as "fact"? Or, as you say, contempt of court or something thrown at them at least? Am I the only one that thinks "justice" in this country is a farce, and lurches all over the place.

A fascinating insight! Thank you for sharing. You're right, it is worrying as a P2P lender if one is relying on such assets for collateral. I have learned my lesson from the catastrophe that was Ablrate. For those who don't know much about them, that platform encouraged us to lend to small and medium size businesses. Almost all my loans - and those of investors I am in contact with - are in default, not having paid either interest or capital for at least the whole of this year and in many cases much longer. While Ablrate are choosing to keep most matters hidden from us, of the loans we have some insight into it is obvious that the collateral is going to be worthless. These securities from these borrowers consist of shoes, gym equipment, cars etc. Nevermind selling them to eventually get 5% of what we were told they were worth, Ablrate is spectacularly incapable of getting a single item from a single borrower. I've lost a lot of money with Ablrate and also investing in other small businesses in the past. It is for this reason I would never lend to a SME ever again who provide collateral in the form of merchandise or Intellectual Property etc. I focus on lending to borrowers with independently-valued, readily-sellable properties here in the UK at a reasonable LTV. Even with having land and properties one has to be very careful and conduct considerable due diligence as the valuations are often farcical. Even at LTVs advertised at 70% by P2P platforms one can end up losing money as a lender. The properties sell at far below the value borrowers are told they are worth and then administrators, lawyers etc. eat up a huge amount of the realised funds. I know about inaccurate valuations from a property I myself sold. The lady valuing it didn't pay much attention to the defects in the building and how run down the vicinity was etc. and she therefore valued it at significantly higher than I thought it was worth - as born out by the fact that the buyer now can't sell it for anything like the price I sold it to him for. Was that a RICS " Professional!" Valuer then?

The Transparency Task Force has suggested with respect to the Woodford funds that investors should register to attend the FCA Annual Public meeting taking place next week on Wednesday 4th October from 10am - 12pm, online, and to take the opportunity to put questions to the FCA about the scandal. Apparently the FCA will be obliged to comment. Should we considering doing the same with regard to Collateral? ( or maybe the lings are already on to this?) I certainly have some questions for the FCA and anyone linked to Collateral, but I couldn't possibly put them here without being banned for obscenity.Is that because you would reference Bailey against a vulgarly described female reproductive organ? Depends oh how big a company you work for, I am not allowed to give work references even if I wanted to where I work. They must come from HR and they will say the minimum. The best and worst person who has worked for me would get the same reference (and that has been the case for all three companies I have worked at recently). Is that the result of decades of PC Lefty Liberal Wokism? Is it fair? Asking for a friend.........

I'd advise her to use a previous landlord or say you'll only provide a factual one relating to occupation dates. Do not lie. It's not a good idea in general and given there will be records relating to this matter (court, insurer, whatever) even a slippy omission of such an obviously relevant fact could be legitimately argued as shared responsibility if something goes wrong. Also, if you provide a paper reference you have no control of how that's used or for how long. False Property Information Form declarations and FCA registers spring to mind. pretty much why employer references these days tend to be: yes they worked for us; we employed them between these dates; they held this position; optional: their salary at end was xxx; we had no reason to sack them for gross misconduct. Were they any good ? No comment. I'd agree. The system works, if you understand it and read between the lines. An ultra basic reference with zero additions, means they weren't any good and you don't recomment them. Decent employees of course get varying degrees of additions/embellishments.
