[quote author=" duck " source="/post/496625/thread" timestamp= FWIW I had very little in the chattels but I simply hate seeing inconvenient matters being hidden away for the convenience of others. Pretty much all my investments in Collateral were in chattels as I sought to diversify from property investments in other P2P operators...for this reason I'm particularly interested in what your research has been revealing...As a complainant who has been receiving can kicking emails from the FCA for 6 years now, I hope to live to see the day where the FCA own their errors and compensate investors for the losses they contributed to.... time to write to my new MP I think...
likewise!
Keep your eyes peeled. Parliament still has to sort itself out which will probably after the summer recess.

Well this might be a busy week. One internal review at the FCA due tomorrow (they have already extended the timescale by 20 working days). FOI's due on, Wednesday and Thursday.
....... and on Thursday the 4 weekly 'update' is due.

This is the text of my request for internal review that was submitted on 20th May, 60 working days ago. I note the Information Commissioner states "We would expect you to get an outcome to the internal review within 40 working days." The ICO is already aware of the FCA's stalling tactics.

Actually, observer, duck has done his usual brilliant job and answered your question very helpfully; ignore all the memo of understanding except for Paragraph 6; that gives a mercifully brief summation of ICO enforcement powers which apply to the FCA and everybody else in its purview.
The liability of individual staff members of the FCA or any other employer is a rather different issue!

I suspect that the FCA is more concerned about reputational damage than anything else. On two fronts:-
1. The reputations of senior figures in, or close to, the public sphere. 2. How this might impact perceptions of the FCA's ability to carry out its regulatory functions (or, indeed, other organisations to which senior FCA figures may have moved to). (3. I guess there might be some collateral (sorry) damage to politicians or the Treasury etc but I see this as very much tertiary).
It's pretty obvious that they are in full "lock down be as unhelpful as legally possible" mode. I can't see any other rational (if shortsighted) reasons for their behaviour, and I suspect it will bite them in the proverbial.

Poor can is taking a kicking today! Surprised the FCA couldn't complete this one in 20 days all I asked for was the names of officers and departments + an exemption declaration ..... In response to this FOI " FCA's 'Internal Stakeholders"

NEWS JUST IN!!!! Another "blah blah" email from our friends at the FCA. Yes but at least they are keeping to the 4 week deadline now Given the number of times it has been essentially the identical response, part of me feels I should be complaining about the length of time being taken. Would raising another complaint about the delay be the only option or is there an alternative channel?

Am thinking of writing to my new MP but as they’re all on holiday at the moment I don’t suppose there’s any hurry.

There is a fair amount of 'new' information that you might like to incorporate but as you say there is no rush, MPs on holiday and the new Treasury Committee won't be formed until after 11th September.
