I have received a totally inadequate reply (from P1 Capital Partners) to my request for information set out above. [My highlighting and underlining]
" Dear xxxxxx
Thank you for the note below, I believe the email address has come from data that an agency are using for some outbound marketing for P1 and the statement below (“You are receiving this email because you opted in via our website”) was incorrectly placed on the mailshot.
I will ensure that the agency removes your details and you will not receive and future marketing from us.
Once again apologies for this misunderstanding
Kind regards Pxxxx "
It is obvious the expert minds at P1 did not check their advert with sufficient due diligence as the claim "you opted in via our website" is not capable of being excused as "incorrectly placed" nor is it a "misunderstanding" - it is a total falsehood.
This lot boast of an address in Berkley Square (it is an accommodation post box) and clearly some of the staff have had connections with Lendy and our very own Mr "Waterfall" LB. See the excellent info from Mousey above.
This spineless lot are now seeking to blame the agency for their own negligence, the clear breach of the DPA and potentially matters for investigation by the FCA.
I have accordingly demanded to know the full details of the agency they are seeking to hide behind. SEE BELOW.

Here is my second request for disclosure sent today to this creation calling itself P1.
"To Mr Peter Ea******
Thank you for your reply which only gives me half the answer.
I want to know the full name and direct contact details of the agency that you have used so that I can find out how they got my details.
The phrase "you opted in via our website" was a total falsehood and cannot be excused as a mistake or simply being "incorrectly placed on the mailshot". You are under a duty to ensure that such adverts are accurate. It would appear to me that this may well become a matter for investigation by the FCA as well as being a very obvious breach of the Data Protection Act.
It would appear that your company have engaged an agency who hold my confidential information and have used it without my permission. What due diligence did your company carry out to ensure that the agent had the necessary authority to send me your unsolicioted and unwelcome advertising e mail?
I want that information within the next 24 hours.
In anticipation, XXXXX"
I await a reply.
It would be good if others were to pile in against this shabby lot of opportunist. They are clearly approaching former investors in the defunct Lendy, and playing on the fact that a new tax year is nearly upon us and seeking to promise high returns for investment into a new FISA cash using their bonds.

Just received this email ....
I have googled the guy can't find any information .
The agency it an independent consultant called S***n Co*******s. He contacted us and offered his services on a percentage basis of any funds raised through his digital marketing activity. We drafted a simple email that was checked over and approved by our compliance function and passed this to him to use. In hindsight we should have conducted more due diligence on the source of the data and for that we are at fault and I apologies for this error. His contact mobile is 0**** *******
Kind regards
Peter E*********k

Once again, thanks mousey. Great detective work.
Yes it is the very same Peter Easterbrook.
This property bond company have failed to reply to my second e mail request for information (set out above).
I see that 11025 has also been in contact with this shabby lot and has received a weasel worded reply trying to excuse themselves but in which they have openly admitted a failure of due diligence.
They may well have had some contact with those responsible for managing Lendy over some time. The geographical locations cannot be a coincidence.
I have now sent a further e mail following the expiry of the 24 hour deadline that I set. Please see below.
[[ " To Mr Peter Easterbrook.
Time to reply ran out for you and your fellow directors at 13.47 pm today.
I know that you received and read my e mail as I have a Read receipt.
You have failed to reply to my second e mail which is particularly unprofessional and does not say much about your work ethic or your approach to dealing with this matter. There has been a wrongful use of my confidential personal information, to which you were not entitled. You cannot hide behind your unnamed agent, if in deed such an agent exists.
Do you think that your failure to reply will instill confidence that you are capable of looking after sophisticated / high net worth investors cash by way of your recently promoted property bond investments?
Are you going to deal with my very reasonable request for full and proper disclosure or are you going to engage in the "head in the sand game" to hope that this mess that you have created will simply go away?
That will not work." ]]
I will be contacting the Data commissioner and the FCA in the morning as this company and the agent need to be investigated.

I'm sure others will if required wade in to support your efforts (I would but haven't received the email, at least not yet). I'm sure plenty of investors would be happy to stick the proverbial kn*fe in to any present or past associates of the Lendy-Clowns. Saying that, you appear to be an unstoppable machine on this one, so a big hand-clap to you! If you want a bit of moral support, just shout. In the meantime, stick to your timescales, and professionally 'go get-em' :-)

Has anyone else complained to the ICO? The Information Commissioner's Office does not take kindly to people's personal information being passed around between companies without the explicit consent of the individual. They have imposed heavy fines on companies guilty of such data breaches: www.itgovernance.co.uk/dpa-and-gdpr-penaltiesIn this day and age where personal data is so immensely valuable (which is why Facebook is worth a fortune, and the reason why Supermarkets offer Nectar points etc...) this is a very very serious issue. You can complain to the ICO here: ico.org.uk/make-a-complaint/Thanks for this. I've just registered a complaint on their site. Very easy to do, just make sure you have the original email to refer to when completing the form.

You can complain to the ICO here: ico.org.uk/make-a-complaint/The ICO are piss poor i am afraid. I have reported several companies in the past for none disclosure of my SAR. You will receive a generic email for the ICO then you will be looking at around 4-6 months before you get by human response. They will not respond to any emails that you care to send them and once they do finally contact you they will request all of the documented information that you have already sent them at the start of the complaint. A useless outfit along with the majority of them and i told them so. All sorted in the end but considering these companies had only 30 days to produce my SAR from request then thanks to the ICO this was extended for them by a further six months and making me look a right idiot. Good luck anyway.
