I understand that people are being paid to have this argument, I just find the secrecy frustrating. Why not release all correspondence between Bootle and Occasio? Why not provide investors with Occasios advice so far to the Administrators? We've paid for this advice! Rhetorical I assume ... Im sure you know the answer ... its usually in the disclaimer at the bottom of any letter sent out by a lawyer.

What's the count of successful Quistclose Trust court cases since 1968 ? Have they just been waiting for the P2P industry ?

I have no idea. What I do know is that there is a large pot of money and an even larger pool of people that will try anything to get their hands on it and keep it from the rightful owners. I had no idea this world existed.

Just made a donation, hope the target is met soon. Good luck and thank you for arranging it. With so much of my investment at risk in P/P investments (investment?), and being in our mid 70`s, I decided to purchase a pre-paid funeral plan for my wife and myself as most of my funds would be a nightmare for executors, some will never be seen again in any case. The agent proudly explained to me that, since 29 July, their Funeral Plans are "Authorised and Regulated by the FCA" which will give me peace of mind by protecting me from any malpractice or fraud . I had to get off the phone, not sure if I was laughing or crying. Just as well the agent did not understand Welsh. I must phone back to apologise, but the irony of it!

I have just added to the legal fund - had a quick look at the what I think is the UK part of the Quistclose directors and I am sure I recognise an interesting name whom I am sure was regarded as a front man for another borrower we are very interested in - as it may not be the same person I am not posting it
Whatever the situation between this Quistclose lender and FS strikes me as very curious if not bizarre and there is something very very very badly wrong here...
As I see it this money may not have been used as directed but tough as FS/we lenders still have 1st charge over the loans - if you lend money then you can ask for surety like the mortgage companies do and in this case they are not entitled to use our money as surety but instead to raise a charge over FS?
I am no lawyer but this strikes me as a dogs dinner and should never have happened if the FCA were doing their job properly...

It makes me wonder if us lenders should be putting in a claim against FCA for not due their due diligence on how Funding Secure were actually working.

Can someone help me understand the current situation: Do I need to formally connect myself to the claim/ legal process to be in with a chance of avoiding the claimant from stealing my money? Or is donating to the Barrister fund and staying out of it sufficient? In the scenario where: 1. It goes to court 2. The barrister agrees to a partial settlement (unlikely as we are all out for blood and if claimant doesn't take our money the administrators will!)

I have just lobbed in some money to help the cause. I think if you are owed money from FS investments you would have to be daft not to contribute. If for no other reason to protect your own ar*e, never mind what you are owed by FS.
Regarding suing the FCA. I was advised some while back that you cannot sue them - they are supposed to be fire proof in law I was informed so don't try!

"Regarding suing the FCA.................................they are supposed to be fire proof in law"Correct. Which is the exact reason for their arrogance, disdain, shirking of any & all responsibility, and exemplary "service" to Financial Consumers. And ask yourself why, in the face of a mountain of verifiable facts & proof of the FCA's countless gross incompetencies, MPs, the Treasury Committee, and Others, STILL do nothing? The rot runs very, VERY deep.

Frankly promoting the previous boss of the FCA "for all his good works" to be boss of the Bank of England IMHO more than stinks beyond description. Has to be the ultimate insult to the likes of us who have suffered and continue suffering. Again in my HO not a Banker but one spelt with a "W".
