neither am I and all the verious FS "explanations" written in obscure English is doing my head in let alone the complex legal arguments.
I guess this creditor (if it is who I think it is has an interesting history) is using this is a blocking technique and certainly been successful to date!
As I said hopefully this nonsense is thrown out but our legal friends will still need paying...

Great work Mousey - hopefully this nonsense is thrown out of court As I said before I don't see what this has to do with loan investors - if this clown has a claim against FS then surely it should come out of their assets - as their assets is zero then they get nothing - tough but that is business

why the hell are we having conversations like this - if FS did their job properly or even legally (?) then we wouldn't! Sadly I don't have undisclosed sums of £500K in my accounts!
I am no lawyer but I will be very surprised if there is any legal case whatsoever for the above - this is so complicated and legally unproven it will cost a mega fortune in legal fees to sort out and get a judgement let alone a court order for the funds. I just don't see how any investor can lend against a secured asset and then have part of the interest/capital deducted because FS entered or did not enter into a Quistclose agreement
A Quistclose trust is a method by which a creditor can hold a security interest in loans, through inserting a clause into the contract which limits the purposes for which the borrower can use the money Surely if there is a case here it is for FS to repay the loan from its assets which (I don't think) are investor funds
Whole thing is a bloody farce gping to bed now - I can sleep quite easily without reading about Quistclose

Totally agree - as I said before this is a legal trick by the borrower JS Star and FS failed to secure our money - what the hell is difficult about secure a charge on a property!

Clearly we have all been shafted here by pernicious criminal activity which has not been helped by the useless FSA
Gone over the Mousey notes again - clearly there is a lot about this case which we have not been told
As I see it James *awyer is highy significant and as per below
this looks like money laundering to me so who was going to buy it? And where was the money to come from - hopefully not from the undisclosed loanbook loans...
Could the buyer be a FS borrower - I wonder! Also just what was the role of *uxmore and is their any connection to the Manchester building lot etc - no idea but the whole lot stinks to me
Looks like this muppet very nearly got away with it but the FBI and the 4 FS lenders stopped this I hope he loses his entire pension and any "arrangement" fee paid to *awyer
Hopefully the press etc will not stop now. As I said looks to me that the Father has really helped his moronic son out - blood is thicker than water but it hasn't repaid my large investment with this muppet so will just have to move on now

Will read your reports again with a clear head - at least the FBI seem to be or were after this muppet
Looks to me as if his very aged and well-respected Father has bailed him out - for a bloke in this 50's this is totally pathetic mental issues- course he had despite being cognisant enough to organise a flight to Spain!

When I invested I contacted FS and explicity asked them if they had these art works in their possession and yes I was told they had - well explain that one FS!

just had repayment details of this one
I had 9 x £25 invested it what I thought were unrelated loans and I get back £2.57 for each loan
Clearly fraud is suspected here on this pathetic return
That said I think we have the private litigants to thank because if left to FS I am sure this would have been a 100% write-off
Well I guess £23.13 out of £225 is more than I was expecting but still totally inexcusable

If this "investment" had say earnt them a killing on a building land deal then I doubt if they would want their money back and the deal cancelled!
I really don't get this - strikes me as complete horlicks and a legal bodge to play for time - also FS never told we lenders what has happening
If you lend money to a company then surely you are either taking a risk as shares or the loan is supportedby a charge?
What we have here seems to be a load of whataboutery based on some mystical report of an unofficial agreement
Or as we learned legal counsel say - total b*llocks!
There is one big time winner here and it is not the FS investors...

Great stuff mah - I wonder if the term Funding SECURE was rightly named ?
Will return to my list of predicted 40 mega losses - think there are going to be well over 30 proved to be correct Also just how many loans have lost 100% - how the hell did they manage that - believe me I have made some bad business decisions in property but never lost anywhere near that.
As I said I wonder just what the hell has happened here - gross incompetence at best....
Yes we have multiple loans with the same directors which I really think we should have been told about
As I said before I wonder if there was a small and cosy cartel with FS complicity controlling the whole loan book that is just an unproven hunch of mine so not accusing anybody of anything but it would help to explain this total bloody farce...
