The judgement has been released after the hearing on 2nd June 2020. It's posted in full in DDC.
Can someone please enlighten me as to why it needs to be in DDC as opposed to the open forum?

Anyone else think of Liam everytime this advert comes on the tv? Was it Lendy Wealth? These guys used to call me to invest. I kept insisting I wanted my loan paid back first. Never worked out. Don't know why... 🤔

In the case of the latter, note that the two founders are currently subject to a worldwide asset freeze and are suspected to have misappropriated several million pounds. Retail investors lending through these firms may lose the bulk of their investment, and the FCA has done little if anything to help them. The advertisment in question may lead members of the public to believe that they will be protected if they trust their money to an FCA-authorised firm, which is clearly not the case."

Good job they were lax with their paperwork and got greedy by trying to claim the payments against corporation tax. Points 3 and 5 indicate that they could have got the money out lawfully if they’d got the paperwork right or even just declared themselves a bonus (but then we come back to them being greedy and avoiding tax). They were clever with the offshore structure but forgot the easy bit which was getting it out OK.
interesting that there is no mention of them intending to defraud investors - just HMRC. No mention of investors at all in fact.
i can see this being a good result for investors in type 1 loans but don’t see how it directly impacts type 2 investors. The money if recovered will go into Company funds and may even end up with them anyway as the shareholders.
