This thread details elements of Claim Ref BL-2020-000856 at the High Court. This first post will be updated as the claims progress, so all the important information is in one place. It is imperative that these proceedings are reported fairly and accurately. If you wish to repeat what is written here please take careful note of the context. E.g. “The cat chased the mouse” is a very different statement to “the court was told the cat chased the mouse”. We have no authority or jurisdiction to determine the truth of any claim or defence – that is a job for a judge having heard all the evidence in court.

I don't see from this if all the £7Mish seems to be recoverable

If money was incorrectly paid to offshore companies resulting in a reduced tax bill, I'm suprised HMRC haven't taken an interest.
I guess even if £6.5m was returned to LY it wouldn't have a big impact in filling the black hole.

I guess even if £6.5m was returned to LY it wouldn't have a big impact in filling the black hole.
Yes I'm surprised they're not represented, they probably will be if they sniff money. It would pay for the adminstration at least. Sounds like they sank the money into property so presuambly it's recoverable.

If the monies are not recovered are there avenues for a criminal prosecution?

So this is all very good and hope that whoever should gets their comeuppance does but even if this money magically made its way back into Lendy would that help us ? I assume it might for the loans on the old contract but I don't see it helping us on anything else ? Sounds like the Administrators and HMRC look to gain but us dumb lenders are still left out to dry !

Surely it is powerful ammunition for the Lendy Action Group court case, so it could ultimately help the lenders by more than the £6.5M.

The question should also be asked if the conveyancers involved in the purchasing of the UK properties mentioned performed adequate AML checks and if SARs were submitted. Indeed, did Barclays Wealth raise a SAR upon 21.3(3)(b)? Likely, we shall never know.
It would be nice to see AML regulations resulting in penalties for those worthy of such invasions of privacy and assumption of guilt and not just causing headaches, delay and cost for every legitimate tax paying Jo(e).
Edit: If I recall, a recent Panorama episode suggested that UK banks were over producing SARs, perhaps suggesting the intention for the regulating system to become swamped or, at the very least, increasing the likelihood of the investigation of (profitable) accounts to be delayed or omitted.
