Same old MO. First borrower claims abuse of process to delay the repossession hearing. Now the director is ill and it's delayed by over another month. Wonder what will be next. I believe he will be kidnapped by a gang of singing cider drinkers & then abducted by aliens. I think thats how it usually goes in these cases.

Seems a different receiver was appointed on the 11th Nov, RM01 form filed at CH 4th Dec.

We hope to obtain vacant possession of the property at the forthcoming court hearing on 9 February 2018.

No doubt the crack lendy team are on top of this (and the connected company strike off)

amused to see the borrower company has just filed accounts at CH.... tangible asset at cost 1/8/2015 £925,000 revaluation £1,945,000 book value 31/7/16 £2,870,000 Was it really that long ago? Ly update 26/7/16 We have regular contact with the borrower, he is going to sell the property in order to repay our loan. He is a finance broker so has good lender contacts if repayment is needed through refinance as well.

Fortunately I'm not stuck in this one but I'm sure the outcome of this loan will be a matter of interest to many.
I note the much delayed hearing to obtain vacant possession of the property had been listed for last Friday - 4 May 2018. I wonder whether the hearing went ahead this time and, if so, what the outcome was.
Google informs me that the borrower, represented by his trusty solicitor who is no longer struck off, had a good win in a Scottish court last month so is on a run of form.

according to the Lendy update (which may or may not be believed), vacant possession was granted. Plan for LPA receiver to let the units before sale.
Good news is that the capital value will increase as a good tenant will improve the covenant. The question of course is how long to find tenants and will they be 'good'??

The question of course is how long to find tenants and will they be 'good'?? well yes the 11th May update was all about letting those vacant units but then a couple of weeks later they were still trying to get possession and get the poor old Des out (and his liquidated firms) still trying early June and by the end of June Des is helping with a bit of renovation work on the now dilapidated new tin shed at least IBM have cleared off and been replaced but our lads are still hoping to take possession soon the loan that keeps giving

5th May update - "Notwithstanding this, the hearing of 4 May 2018 went ahead and possession of the relevant units from the tenant company linked to the borrower was obtained"
20th July update - "The dilapidation works in relation to Unit 2 are almost complete. Possession proceedings in relation to Unit 1 continue and should be resolved in the next 4-6 weeks."
Looks like Des (and/or his son) is still giving Lendy/the administrator the run around - 2.5 months to execute a court order and still counting....
