You may be right there Meledor, as I am not a lender and do not have the emails. But if lenders start asserting platform liability for a loss, then that will cause a cessation of information which is at all relevant to the question of liability - the solicitors will insist. That may be why information is not forthcoming, as you say it is not. The last stages of a failed project are well known to be the search for the guilty followed by the punishment of the innocent. Not the other way round.

To be fair, I don't see why they should waste their time emailing people individually when they have a planned update coming out. Firstly, where did you get the information that this was a planned update? AFAIK there was no information given about planned updates. Secondly, there is a distinct lack of input from Ablrate on the 2 loans which have issues, the Container loans and the ATR 42-500 MSN 532 loan. Lenders have to continually ask for answers. Thirdly, see my post at the start. Despite sending Ablrate a PM and an email to their CEO asking them to explain how the situation arose, they have never replied. Some lenders are too quick to jump to the defence of platforms. There seems to be a fear that if we upset them we will not get to be involved in their loans. Without lenders there will be no business. It is our money at stake here, not theirs. Despite what Ablrate says, there is a distinct conflict of interest in the ATR 42-500 MSN 532 loan. This has been covered in other posts. I have taken advice on the January container loan and Ablrate have a clear liability here. Forgive us not responding - would you mind resending and we will get a response out? I believe we have been pretty good at getting updates out individually on both the containers and 532 (I do believe the criticism on 532 is unfair, as we have been diligent in letting all know when there is material news), but we are aware that some emails are not getting through, so here is what we are doing about that: We route emails through a third party which (ironically) is supposed to increase delivery, which it does, but one email lost is too many. We are now in the process of changing a few back-end functions in relation to our domain name, which will (we are advised) have the effect of not tripping some of the ISPs spam filters and it should also be more friendly to those of you who have your filters set higher than most. This will make sending the individual emails (the system emails have a very high delivery rate) more efficient and we hope to have that done within the next couple of weeks as we have some fairly chunky updates coming to the next week. We will also be building a notifications system on the dashboard, the affect of which would allow you (if you prefer) to switch off email notifications and pick up those notifications on your dashboard. On the containers, we are working through the legal process as advised. We do not mind criticism, it comes with the territory, and only serves to help improve our systems and procedures. We think that forum members are generally very fair in the balance between criticism and positive feedback so we have to take the rough with the smooth. It is frustrating sometimes, not to be able to engage in open debate to the extent that we would like to, especially when things do not go according to plan, but we also have to have a fine balance of what is said here and what isn't. Regards Ablrate Mine never got a response either, just an out of office due back today. I assumed that it had been 'lawyered' as Id always had a response before. See if I can find and resend

Maybe you should pursue this legally with Ablrate then if you feel you have a clear case. You might then appreciate that the legal system can take considerable time. I am more than happy Ablrate are pursuing this to the best of their ability. More frequent updates, even if just that they are no further on, would give more confidence the process is continuing in due course, but this doesn't appear to be how Ablrate are handling this. You might want to chill a little as things are likely to take quite a bit longer without much changing for fairly long periods in between updates All I am asking for is a response to the PMs and the email I sent. The worst thing any business can do is ignore their customers. This may not have been ablrate 's intention but no response to a serious question upsets people and is not good for relationships. With regard to pursuing a legal claim, a claim registered under the "small claims court" requires a response within 14 days and is designed to be a quick process with nominal costs incurred by the pursuer. I have no desire to follow this route but merely want answers to a serious question. No problem, resend your email and we will get a response out as best we can.

Update email today, still working through the court process, might be an update from the court next week, or not. I read but didn't understand. Did that email mean that Abl has an update from the court, or from the borrower or the court has an update from the borrower or some other variation?

Agree with you there James. For anybody who has never dealt with the Court System in the UK it does have it's own way of doing things. I hand delivered a bundle to the Royal Courts of Justice and was told that whilst I had used the correct ribbon to tie it together I had used the wrong knot! Frantic re-tying necessary ..... The devil is in the detail and I am content that Ablrate are ensuring that the detail is being dealt with.

Really unfair to them. Now you can attach that bundle online, select a predetermined length of virtual ribbon of correct colour - length calculated for you - and you tie the knot using two fingers on a touchscreen. Submit and wait. Simples!
