Can someone point to the legal issues around identifying borrowers and other parties involved publicly?
Thanks.

Whenever I receive an email from SS informing me a loan is about to go live the first thing I do is read 'Cooling Dude's' post. I find the information extremely helpful and I am very disappointed he has been "asked" to stop. If there is no legal reason for this then I am extremely angry with the Mods. If there is a good reason then a "friendly" warning would have sufficed. To threaten 'Cooling Dude' for an honest mistake is bang out of order! I think some of the Mods should be sent on a Man Management course!!

Can someone point to the legal issues around identifying borrowers and other parties involved publicly? Thanks. There are probably no legal issues as far as SS loans are concerned as long as the post does not contain a defamatory comment. There could be an issue with loans where the borrower is an individual who has borrowed less than £25,000 as this falls within conumer credit law and there is a legal prohibition from naming and shaming, considered as harrassment, if they default (as far as I am aware no Savingstream loan falls into this category). There could however be two potential problems, the wrong person/company might be identified as the debtor, or the practise could overlap into other platforms. In the first case it could be defamatory and cause the debtor reputational harm for which they might sue and secondly it is dificult to write the same rules for diferent platforms eg the anti harassment regulations would apply to most loans on Zopa/Ratesetter but few on all of the other platforms. However having said all that it should not be outwith the wit of man or the moderators to have dealt with this in a more accomadative manner which would have satisfied all parties, themselves, cooling_dude and the vast majority of other posters as demonstrated by the support here.

Moderaters havent said how long they want to ban C-D. C-D would like to continue. C-D work is amazing, help me a lot. Could a compromise be reached for both partys by banning for a day or a week or a agreed lenght of time.

As I understand it cooling_dude has not been banned but has declined to make any firther Due Diligence posts as this seems to cause, in his opinion, angst amongst the moderators. Whilst one should never say never over time opinions may moderate (no pun intended)

P2P Independent Forum and C-D is such a good, clever place. It would be less good and clever without C-D. I hope a solution can be reached.

I would encourage people to return to discussing Saving Stream and / or its loans.
RMRobust, challenging DD is at the essence of discussing Saving Stream and its loans.

I did express my discontent, and it was largely implied that my activity here was a burden. I don't want to be a burden, I don't want to be banned... and I certainly don't want to be 'pre-moderated' (a suggestion put forward by the MODs) . DUDE, I can help rename the titles for you, when I can… I can concoct a title of sorts from the pictures! So for instance in the Pipeline loans page; PBL143 – Grey steel and brown brick in the ‘Smoke’. PBL??? – House in a wood, Central. PBL??? – No entry in the West. PBL??? – Brown brick and tile in the East. Surely, no MOD will complain about the BURDEN, with concocted titles like that? Could also have a competition, when you load the new loan page... Try and turn a negative situation into a positive one!

CD is probably the biggest contributor to the SS forum and must put in hours of unpaid time to make the forum better, and more useful to everybody. His DD posts are always littered with *****s so it's obvious he tries hard to comply with forum rules. But he's only human and anybody can make a mistake.
The tone of the moderation on here does sometimes leave a bit to be desired. Threatening to ban the biggest contributor of DD for what seems to have been an innocent error is a totally disproportionate response in my opinion. Perhaps the Mod was having a bad day but forum moderators should at least treat contributors with respect and remain polite. And if anyone can't I think they should step down and leave it to others with better people skills.
All this will do is lead to more and more information being shared by PM and the public forum will become less useful.
If we have seen the end of CD's DD threads then I'd like to thank him for sharing so much of his work with us and for the great help his posts have been to me.

Would anyone happen to know if SS do a payments run on a Saturday morning ?
ie. If I were to make a payment right now (Friday evening), will SS credit the payment to my account tomorrow, given that it's a Saturday. Thanks.

They are launching a new loan tomorrow, so if you send the money and an email to let them know, I would think there is more than 50% chance that they will process the money.

If we have seen the end of CD's DD threads then I'd like to thank him for sharing so much of his work with us and for the great help his posts have been to me. Whilst there are three types of lies, lies, damned lies and statistics the only othe platform to be anywhere near the SS board in terms of threads and posts is Assetz Capital and I would imagine that is because they funded the setting up of the forum and actively encourage participation by its members. Similarly I believe the main reason for SS's numerical supremacy and high proportion of people viewing at any one time is largely due to the contribution of cooling_dude and others in the way of meaningful Due Diligence unmatched by any other contributor(s) to any other platform's forum. Perhaps a way around this preserving C_D's honour and keeping the moderators duty fulfilled is an analogy to the legal principle of best and reasonable endeavours. Under the former a party makes a binding undertaking to do something if they fail to fulfil that the other party is due compensation. With reasonable endeavours a party undertakes to do something but if they are prevented from doing so they have a defence against a claim from the other party. If C_D undertakes to use his reasonable endeavours to not name or identify a debtor but if he fails (because like all humans he sometimes makes mistakes) the moderators are at liberty to rectify the error without reference to him. Although he is a prolific poster he only rarely has such a lapse so the burden upon the moderators should not be significant and I would wager most of them read his posts anyway as investors in SS even if they do not use the information. If such a solution is not found I believe the SS forum will whither and die (much like the Zopa board where first of all it migrated here because of under use, and it hasn't had a single post this month) or perhaps that is the intention?

It is very rare these days that one agrees with every single (non admin) post written in a long thread such as this. I'm new to this forum but in my short time here, C D was the person who first answered my questions in a straight-forward and knowledgeable manner for which I was grateful. Since then, I went on to invest in SS and other p2p platforms.
I'm a software engineer and I know that forum software and hosting is simple and inexpensive. It is the content that drives popularity and it should be encouraged and nurtured or it will move elsewhere.
